我国自首的萌芽源于西周，草创于秦，通过汉代的发展，于唐代达到巅峰，后由宋、元、明的不断补充，到清代已相当完善并形成了鲜明的时代特征。
自首制度作为刑法体系中一项重大的量刑制度，它经久不衰的原因在于其对于社会稳定有着特殊的作用。自首制度可以使犯罪分子悔过自新、改恶从善，从而节约司法成本、提高司法效率、深挖余罪，同时，有鼓励人民群众积极与犯罪分子、犯罪行为作斗争的作用。
清代自首制度一般分为三大类，包括：准首之事、不准首之事以及不经官自首及盗捕同伴自首之事。
但不同的自首类型在司法实践的运用上存在着一定的弊端。在清代，自首制度的规定并不完善、制度也有前后矛盾的地方，使得官员在案件的处理上产生偏差。
自首制度需要改革，只有在自首后刑罚的判定上有所减轻，其积极作用才可以得到更好的体现。随着社会的进步，自首制度需要在取前代精华的同时不断完善，以便适应当今社会的形势。
